My partner and I have a common law marriage in Alabama(where they are recognized as being legally married). We are going into a custody battle and need to know if that will hold up in court as being legally married or if we need to go to the Courthouse and get married that way. Will do that if necessary but would rather not(having wedding later this year) if the answer to my Q is yes. Thank you. They are my partners kids and they are in the temporary custody of the girl’s parents. So we are going against the Grandparents.Want to make sure when we go to court and say we are married that it will hold up. just trying to be prepared.
Not what I asked for. I know about the “best interest” standard. Was just asking if common law held up in court and stated why I was going.

Critics of the law said Monday they’ve sent letters to Mercedes-Benz parent Daimler AG, Honda and Hyundai seeking meetings to discuss the law. The president of the Leadership Conference on Civil and Human Rights, Wade Henderson, says opponents want the companies to help them fight to overturn the law.
